Short article for now, but some breaking news of a victory on the COVID front. In a rare Saturday/Holiday decision, Federal Judge Justin Walker issued a Temporary Restraining Order against the Red Mayor of Louisville who banned Easter Church Services city-wide.
The Injunction was issued after a few courageous attorneys acting on behalf of On Fire Christian Church challenged Louisville's Mayor Greg Fischer and the increasingly unstable Governor Brashear (of whom we said more in the previous post). On Fire, which according to their website appears to be a fairly typical Evangelical congregation, planned to hold a 'drive-in service' on Easter Sunday. Mayor Fischer---an evil Leftist with ties to Big Pharma ---instead wishes to stamp out all religion. However, Fischer's scheme hit a roadblock with Judge Walker: one of the new breed of federal judges appointed by President Trump.
Judge Walker, who formerly clerked for Justice Brett Kavanaugh, wrote:
"On Holy Thursday, an American mayor criminalized the communal celebration of Easter.
That sentence is one that this Court never expected to see outside the pages of a dystopian
novel, or perhaps the pages of The Onion. But two days ago, citing the need for social distancing
during the current pandemic, Louisville’s Mayor Greg Fischer ordered Christians not to attend
Sunday services, even if they remained in their cars to worship – and even though it’s Easter. The Mayor’s decision is stunning.
And it is, “beyond all reason,” unconstitutional."
He further stated that: "...the Free Exercise Clause protects their right to worship
as their conscience commands them. It is not the role of a court to tell religious believers what is
and isn’t important to their religion, so long as their belief in the religious importance is sincere.
The Free Exercise clause protects sincerely held religious beliefs that are at times not 'acceptable,
logical, consistent, or comprehensible to others.'"
And added that, "... constitutional rights still exist. Among them is the freedom to
worship as we choose. The brief history at the outset of this opinion does not even scratch the
surface of religious liberty’s importance to our nation’s story, identity, and Constitution."
Anyone interested can read the full text of the decision here. Judge Walker spent a good 20 pages schooling the Whacko Left on the 1st Amendment, among other matters.
Incidentally, Judge Walker was recently promoted by President Trump to serve on the DC Court of Appeals and was confirmed by the US Senate. He'll assume that position on September 1st.
